JUST IN: New York Passes Law Allowing People To Sue Gun Manufacturers For Violence

(Patriot Insider) – Now that the COVID emergency in the state of New York has ended, Governor Andrew Cuomo is wasting no time taking yet another step in transforming the once great state into a liberal dystopia.

The unhinged governor signed a law on Tuesday passed by the Democrat-controlled state legislature allowing for guns to be considered a public nuisance and opening the door for gun manufacturers to be sued for misuse of their products.

“The only industry in the United States of America immune from lawsuits are the gun manufacturers, but we will not stand for that any longer, Cuomo said in a news release.

The federal Protection of Lawful Commerce in Arms Act of 2005 carved out immunity for gun manufacturers if individuals misuse their products in a criminal manner.

Gun manufacturers should not, of course, be held liable for the way in which gun owners use their guns. It’s completely absurd to think they should. Cuomo, however, is changing all of that in New York.

“Under this new legislation, gun manufacturers cannot endanger the safety and health of the public through the sale, manufacturing, importing or marketing of the products they sell. The products can be considered a public nuisance even if the gun manufacturer did not purposely cause harm to the public,” a news release by Cuomo says.

The release went on to say that now anyone from private citizens to corporations to the state attorney general herself can take aim at “bad actor gun manufacturers.”

The release by the Governor also claimed that federal protection of gun manufacturers has “created a perfect storm of lax controls and inability to hold bad actors to account.”

Naturally, Democrat State Attorney General Letitia James, who strongly opposes the National Rifle Association, is on board with abridging the federal law.

“Plain and simple, this was federal overreach to protect the gun industry in every way possible,” she said. “But, today, New York state took an important step to right that wrong and protect its citizens from gun violence.”

There is, of course, absolutely no logic in James’ argument whatsoever. Allowing gun manufacturers to be sued for “misuse” of their products will do nothing in stopping criminals from using guns in criminal ways.

Cuomo signed the law on the very same day he announced that he would be declaring gun violence a public health emergency in the state of New York. This guy just can’t get enough of emergency declarations.

State Senate Minority Leader Rob Ortt called Cuomo out for his blatant “political grandstanding”.

“Days after finally relinquishing his emergency powers, the governor has declared another emergency,” Ortt said.

He also aptly pointed out that in reality the gun violence plaguing cities across New York is a direct result of the abysmal “criminal justice reform” measures taken by woke liberal radicals like Cuomo and NYC Mayor Bill de Blasio.

“The crisis in cities across our state today directly correlates with the passage of the disastrous bail and other criminal justice ‘reforms,’ an out-of-control parole board that has released countless murderers and other dangerous criminals, and calls by Democrats to defund our police,” he said.

Until Governor Cuomo is replaced by someone more sane and not beholden to a radical political agenda, there will be no hope for New York. No wonder Americans are fleeing the Empire State in droves.

  3. The state of Washington tried something called ‘vicarious liability’ around 40 years ago. That was predicated on the same flawed ‘idea’ of making manufacturers liable for misuse of virtually any product. What – you mean that you never heard of that – of course you didn’t because a modicum of common sense was still in play – unlike what is going on there these days,
    ANY judge that does not immediately throw out a case filed under this ‘law’ needs to immediately removed from the bench AND have their law license revoked.
